Introduction
These Terms and Conditions ("Terms") govern your use of this website and the services offered by FNQ Design And Build Constructions. By accessing or using this website, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may Cancel your Pre-Purchase Building Inspections and or Building design Plan at the check out.

Service: Pre-Purchase Building Inspections
We offer pre-purchase building inspections for various property types. The specific details of each service, including the scope of the inspection and the deliverables, will be outlined in the product description on the checkout page.
Scope of Inspection: Property and Surrounding Area
Our pre-purchase inspection focuses on the main building and its readily accessible systems. We will inspect the property itself and the surrounding area within a 30-meter radius of the house. This includes:
- The main building: This encompasses the foundation, roof, walls, interior elements (walls, ceilings, floors, doors, windows, fixtures), and readily accessible plumbing, electrical, heating, cooling, and ventilation systems.
- Outbuildings: Garages, sheds, or other small structures attached to or within 30 meters of the main house will be visually inspected for major structural issues.
The inspector need not inspect or report on the following as per the AS4349.1 Australian Standard.
Footings below ground- Concealed damp-proof course- Electrical installations- operation of smoke detectors- light switches and fittings- TV- sound and communications and security systems- Concealed plumbing- Adequacy of roof drainage as installed- Gas fittings and fixtures- Airconditioning- Automatic garage door mechanisms- Swimming pools and associated filtration and similar equipment- The operation of fireplaces and solid fuel heaters, including chimneys and flues- Alarm systems- Intercom systems- Soft floor coverings- Electrical appliances including dishwashers, incinerators, ovens, ducted vacuum
systems- Paint coatings, except external protective coatings- Health hazards (e.g., allergies, soil toxicity, lead content, radon, presence of asbestos or urea formaldehyde)- Timber and metal framing sizes and adequacy- Concealed tie-downs and bracing- Timber pest activity- Other mechanical or electrical equipment (such as gates, inclinators)- Soil conditions- control joints- Sustainable development provisions- Concealed framing-timbers or any areas concealed by wall linings/sidings- Landscaping- Rubbish- Floor covers- Furniture and accessories- Stored items- Insulation.
Important Note:
- If there are additional structures beyond a single outbuilding or detached garage within 30 meters of the main house that you want inspected, this will require a revised inspection plan and a separate quote. We will be happy to discuss your needs and provide a custom quote upon request.
- To ensure transparency, we may refine the inspection price after the consultation to reflect the specific needs of your property.

Booking and Payment
- To book a pre-purchase inspection, you must complete the Purchase online.
- Payment for the inspection service is due in full at the time of booking. We accept secure online payments through Paypal.
- Once your payment is confirmed, We (FNQ Design and Build Constructions) will contact you to arrange a suitable date and time to inspect the property, and gain further information regarding the building being inspected.
Inspection Process
- You are responsible for ensuring the property is accessible for the inspection at the scheduled date and time.
- Our inspector will conduct a visual inspection of the property in accordance with relevant industry Australian standards AS 4349.1, 2007 and the specific details outlined in the product description.
- We cannot perform any destructive testing or move furniture or personal belongings to access areas.
Report Delivery
- You will receive a comprehensive inspection report within 5 business days of the inspection.
- The report will detail the findings of the inspection, including any identified defects, potential issues, and recommendations for further evaluation.
Limitations of Liability
- Our inspection is a visual assessment and does not guarantee the identification of all potential defects or issues.
- We are not liable for any latent defects or hidden problems that may not be readily apparent during the inspection.
- Our report is for informational purposes only and should not be considered a substitute for professional advice from qualified specialists such as engineers, architects, Builders, Plumbers, Electricians, etc.
Cancellation Policy
- You may cancel your pre-purchase inspection booking with at least 2 days' notice prior to the scheduled date for a full refund.
- Cancellations with less than 24 hours notice will be subject to a $50.00 cancellation fee.
- No-Shows or Same-Day Cancellations: If you fail to attend an inspection or cancel on the day of the inspection, your payment will be non-refundable.
- Rebooking Fee: A rebooking fee will be charged for any rescheduled inspection. The fee will vary depending on the location of the property and will range from $250 to the full price of the original inspection.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia.
Dispute Resolution
In the event of any dispute or claim arising out of, or relating to the Inspection or the Report, you must notify us as soon as possible of the dispute or claim by email, fax or mail. You must allow us (which includes persons nominated by Us) to visit the property (which visit must occur within twenty-eight (28) days of your notification to us) and give us full access in order that we may fully investigate the complaint. You will be provided with a written response to your dispute or claim within twenty-eight (28) days of the date of the inspection.

Entire Agreement
These Terms constitute the entire agreement between you and us regarding your use of this website and the services offered.
Updates to Terms
We may update these Terms at any time by posting the revised Terms on this website. Your continued use of this website following the posting of revised Terms constitutes your acceptance of the revised Terms.
Service: Building Design Plans
Welcome! We offer downloadable building design plans to help you visualize your dream home. By purchasing a plan from our website, you agree to the following terms and conditions:
1. Plan Ownership and Use:
- Upon purchase, you will receive a digital copy of the building design plan. You are granted a non-exclusive, non-transferable license to use the plan for personal, non-commercial purposes only.
- You may modify the plan for your own use, but we recommend consulting with a licensed architect or engineer for any significant modifications.
2. Local Building Regulations and Approvals:
- Important Disclaimer: It is your sole responsibility to ensure the purchased building design plan complies with all applicable building codes, regulations, and zoning requirements set forth by your local governing authority.
- While our building design plans are designed in accordance with the National Construction Code of Australia (NCC), it is important to understand that local building codes and regulations can vary significantly across states and territories in Australia.
- You may need to modify the plan or obtain additional permits and approvals before construction can begin.
- We recommend consulting with a qualified architect or engineer in your area to review the plan and advise you on any necessary adjustments for compliance with any variations from the NCC specific to your location. This may involve modifications to meet stricter regulations or adaptations to suit site conditions.
3. Warranties and Disclaimers:
- We strive to provide high-quality building designs. However, the designs are sold "as-is" and without warranties of any kind, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, or accuracy.
- We are not liable for any damages, losses, or costs arising from the use or modification of the building designs. This includes any costs associated with failing to obtain building permits or needing to modify the design for local compliance.
4. Limitation of Liability:
- Our liability to you for any claim arising out of or related to the purchase or use of the building designs is limited to the purchase price of the design.
5. Copyright and Intellectual Property:
- The building designs are protected by copyright. You may not reproduce, distribute, sell, or share the designs with any third party without our express written consent.
6. Governing Law:
- These terms and conditions shall be governed by and construed in accordance with the laws of Queensland, Australia.
7. Dispute Resolution:
